Those defendants include Statebridge Company LLC, American Modern, American Modern Insurance Group (AMIG), and Midwest Enterprises. Allegations include breach of contract, breach of implied covenant of good faith and fair dealing, violation of the New Jersey Consumer Fraud Act (NJCFA), breach of fiduciary duty, and violations of the Racketeer Influenced and Corrupt Organizations Act (RICO).

The defendants, or so it is alleged, “manipulated the force-placed insurance market through collusive agreements involving kickback arrangements and other forms of improper compensation,” DiGiacomo says in his Force-Place Insurance class action.

The defendants immediately filed a petition with the court to have the lawsuit dismissed on various grounds. In his decision this past June, District Court Judge Joseph E. Irenas of the US District Court for the District of New Jersey agreed with the defendants and granted their motion, in part, related to DiGiacomo’s breach of contract claims. However, the remainder of the defendant’s motion to dismiss was denied.

CINCINNATI (AP) — While an Ohio man was on electronic monitoring in an abduction case, he had a 14-year-old girl dropped off at his home by taxi, held her captive for months and raped her, according to criminal charges and court records.

Cody Lee Jackson, 20, fled the state without the girl after pleading guilty this summer in the abduction case to a charge of interference with custody; charges of abduction and kidnapping were dismissed, state court records show.

He was arrested last week in Utah when he tried to run away after giving a fake name to drug task force officers conducting a routine stop at a bus station, according to Salt Lake City jail documents. He is to be brought back to Ohio for sentencing on the interference conviction and to face numerous federal and state charges stemming from his alleged crimes while on electronic monitoring.

DETROIT (AP) — A Detroit-area man convicted of having his wife killed so he could devote himself to a life of bondage and domination with another woman testified Thursday in his quest for a new trial that his wife gave him permission to have extramarital affairs.

Bob Bashara testified in Wayne County Circuit Court as he seeks to have his first-degree murder conviction and life sentence thrown out, saying his rights were violated by an ineffective defense. He testified that his trial attorneys advised him against taking the stand at his salacious trial last year.

“I felt that I was grossly misled by that,” Bashara said.

A jury in December convicted Bashara of murder in the 2012 death of Jane Bashara, whose body was found inside her Mercedes-Benz. The luxury SUV was ditched in a Detroit alley.

Prosecutors have said Bob Bashara, 57, coerced handyman Joe Gentz into strangling her at the couple’s Grosse Pointe Park home. Gentz is in prison after a second-degree murder conviction.

Patient attacked at Washington hospital as US funds at risk

SEATTLE (AP) — A patient attacked another patient at Washington state’s largest psychiatric hospital this week as federal regulators decide whether to cut millions of dollars to the facility over concerns about safety.

Doctors at Western State Hospital say the number of violent episodes at the 800-bed facility is rising because staffing levels are inadequate, making the facility increasingly dangerous for patients and workers. The state agency in charge of mental health services says it has asked lawmakers for more money to hire the workers needed to operate safely.

Dr. Joseph Wainer, a psychiatrist with the hospital for 10 years, said the facility has never been so dangerous, and it will take a major shift to make it safe again.

“The medical staff had recommended a freezing of admissions until they get it under control, but we were told we should think about finding another job,” Wainer told The Associated Press on Thursday.

The federal Centers for Medicare and Medicaid Services sent a 90-day termination notice to the hospital on Sept. 21 after investigators said staff members mishandled a previous patient-on-patient assault. It was the hospital’s third warning that nearly $16 million in annual funding could be cut.

LAS VEGAS (AP) — Nevada regulators ordered daily fantasy sports sites like DraftKings and FanDuel to shut down Thursday, saying the hard-to-miss sites that have flooded the marketplace with TV and Internet ads cannot operate in the state without a gambling license.

The decision comes amid growing backlash by regulators and investigators, including New York’s attorney general, after it was revealed employees often played on competing sites, raising questions about possible insider information being used to win.

Nevada regulators govern the country’s main gambling hub in Las Vegas, and their actions could hold sway with regulators elsewhere.

Participants on the unregulated sites can compete in games involving professional or college sports, paying an entry fee that goes into a larger pool. SACRAMENTO, Calif. (AP) — Eight men were charged Thursday with making and distributing dozens of firearms, many of them assault-style weapons illegally equipped with silencers, in what federal officials are calling one of the biggest takedowns in California’s Central Valley.

Undercover agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives purchased or seized more than 230 firearms and silencers. Many are known as “ghost guns” because they lack serial numbers and can be sold without background checks or transfer documents.

“Firearms trafficking such as that alleged in this indictment is one of the primary sources of crime guns found on the streets, and the manufacture of untraceable, unserialized firearms hampers criminal investigations, putting the public at greater risk,” U.S. Attorney Benjamin Wagner said at a news conference. “High-capacity assault rifles, with silencers but without serial numbers, are some of the most lethal weapons that criminals can get their hands on.”

The charges include dealing in firearms without a license, unlawfully manufacturing firearms, possession of silencers, short-barreled rifles and firearms lacking serial numbers, and conspiracy. Three of the eight face separate drug charges, which Wagner said shows a connection between gun and narcotics trafficking.

NEW HARTFORD, N.Y. (AP) — The latest on the fatal beating of a 19-year-old inside a church (all times local):

8:30 p.m.

Hospital officials say the condition of a 17-year-old who allegedly was seriously beaten by relatives and fellow members of a central New York church is improving.

That’s according to Lt. Timothy O’Neill of the New Hartford Police Department, who says Christopher Leonard remains in the intensive care unit.

Christopher’s 19-year-old brother, Lucas, died from the pummeling that authorities say was an effort to get them to confess their sins.

Their parents, Bruce and Deborah Leonard, are charged with manslaughter in Lucas’ death. Four other adults, including the victims’ sister, are charged with assault in the younger brother’s beating.

All the suspects pleaded not guilty.

A lawyer for a father charged with manslaughter in the beating of his teenage son at a central New York church says the incident arose from a family meeting, not a church function.

LAS VEGAS (AP) — A jury watched intently Thursday as a prosecutor showed video from multiple angles of perhaps the most stunning scenes of carnage ever on the Las Vegas Strip: A vehicle-to-vehicle shooting, a high-speed crash that sent cars spinning, and a fireball that left three people dead — including two who burned to death in a taxi in front of glittery casino marquees.

“They’re shooting each other right there, see?” said a driver in a taxi recording dashboard video of a black Range Rover SUV with a blinking right turn signal edging close to a silver Maserati at a traffic signal. The vehicles accelerate, and more shots are heard.

“Oh!” said a passenger as a fireball erupts. He and another passenger pull out cellphone cameras. One says it looks like a Hollywood movie.

“No way! Right in front of Caesars Palace!” one exclaims.

Prosecutor David Stanton pointed across the courtroom at defendant Ammar Asim Faruq Harris, and he called him the person responsible for the “premediated intentional and deliberate murder” of three people.
